Terms of Service

These terms are an agreement between you and SendHustle ("SendHustle", "we", "us") covering your use of the SendHustle email platform at sendhustle.com. By creating an account or sending through the service, you accept them.

1. Your account

You must provide accurate signup details and keep your credentials and API keys secure. You are responsible for everything done through your account, including by anyone you invite to your workspace. You must be legally capable of entering into this agreement, and you may not use the service if you are barred from doing so under applicable law.

2. What the service does

SendHustle sends email on your behalf from domains you verify, and reports delivery and engagement. You keep ownership of your content, contacts, and templates. We access them only to operate the service, to prevent abuse, or where the law requires it.

3. Acceptable use

Email reputation is shared infrastructure, so these rules are enforced strictly. You agree that you will not:

  • send to purchased, rented, scraped, or otherwise non-consenting recipient lists;
  • send unlawful, deceptive, fraudulent, or phishing content, or impersonate any person or organisation;
  • send from a domain you do not control, or forge sender or header information;
  • remove, disable, or bypass unsubscribe links, suppression lists, or sending limits;
  • distribute malware, or content that is defamatory, obscene, or infringes another party's rights;
  • resell or provide the service to a third party as your own without our written agreement.

Recipients must have given you permission to email them. We may require evidence of that permission.

4. Sending limits and fair use

Each plan includes a monthly email allowance and other limits described on the pricing page. Sending is paced to protect deliverability, so large campaigns are delivered over time. We may reduce limits, pause sending, or suspend an account whose bounce or spam-complaint rates threaten the platform's deliverability for other customers. Where practical we will tell you first and explain how to resume.

5. Fees, billing, and taxes

Paid plans are billed in advance for the chosen period (monthly or yearly) at the price shown at checkout. Indian customers are billed in INR through Razorpay; customers elsewhere are billed in USD through Dodo Payments, which acts as merchant of record and collects any applicable sales tax or VAT. Prices are inclusive of taxes only where stated.

Whether a plan renews depends on how you paid. Plans paid in USD through Dodo Payments are subscriptions: your payment method is charged again automatically at the start of each period until you cancel. Plans paid in INR through Razorpay are not subscriptions — a payment buys a single period, nothing is charged automatically, and your account returns to the Free plan when that period ends unless you buy another. 6. Cancellation and suspension

You may cancel at any time from your dashboard; access continues to the end of the paid period. On a USD subscription, cancelling stops the next automatic charge. An INR plan has no automatic charge to stop — it simply ends when the period you paid for runs out. We may suspend or terminate an account that breaches these terms, that we reasonably believe is being used for abuse or unlawful activity, or that has unpaid fees. Serious abuse may be actioned immediately without notice.

7. Availability

We work to keep the service available and monitored, but it is provided on an "as is" and "as available" basis without warranties of any kind. We do not guarantee that any particular message will be delivered or will reach a recipient's inbox rather than their spam folder — delivery decisions are made by receiving mail providers, not by us.

8. Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental, special, or consequential loss, or for lost profits, revenue, data, or goodwill. Our total liability for any claim relating to the service is limited to the fees you paid us in the three months before the event giving rise to the claim.

9. Your responsibilities as a sender

You are responsible for complying with the laws that apply to your sending, which may include the Indian Information Technology Act and its rules, GDPR, CAN-SPAM, CASL, and similar regimes. You agree to indemnify us against claims arising from your content, your recipient lists, or your breach of these terms.

10. Changes

We may update these terms; the "last updated" date above reflects the current version, and material changes will be notified by email or in the dashboard. Continuing to use the service after a change means you accept the updated terms.

11. Governing law

These terms are governed by the laws of India, and disputes are subject to the exclusive jurisdiction of the courts of India.
